What does the procedure involve?
Everything begins when the victim, or someone acting on their behalf, files a complaint with the police, the duty court or the Public Prosecutor’s Office.
PROTECTION ORDER
After the complaint is filed, an immediate application can be made for a protection order. This may include urgent precautionary measures to protect the alleged victim.
Such measures may involve prohibiting the alleged aggressor from approaching or contacting the victim and, in certain cases, decisions regarding child custody or the use of the family home.
INVESTIGATION PHASE
An investigation phase begins in which all necessary evidence is gathered, including witness statements, medical reports and forensic evidence. This stage is crucial in determining whether the case is viable to proceed to court.
COURT HEARING
If there is sufficient evidence, the case proceeds to trial. During the hearing, both parties (prosecution and defence) present their arguments, evidence and testimonies before the court in an oral hearing.
JUDGMENT
After assessing the evidence and arguments, a judgment is issued. This may include criminal measures (such as prison sentences, restraining orders or communication bans) and civil measures (such as child custody, use of the family home or maintenance payments).
APPEAL
The judgment issued by the criminal court may be appealed within a period of five days before the Provincial Court.

You probably still have questions
I have prepared a list of some of the most frequently asked questions. If you still have doubts, write to us at hola@abogadoviolenciadegenero.com and we will be happy to help.
Your lawyer will focus on the lack of credible evidence and identify any inconsistencies in the accuser’s account. Witness statements and documentary evidence (emails, messages, etc.) may also be used to support your defence.
Breaching a protection order is a serious criminal offence and may be punishable by a prison sentence of between six months and three years.
Consider seeking emotional support through counselling or therapy. Maintaining a healthy routine and engaging in activities that help you relax can also be beneficial.
In some cases, reports may also be filed by witnesses to the events, including law enforcement officers or medical professionals assessing the alleged victim, who may submit medical reports directly to the court.
In domestic violence cases, the absence of evidence can sometimes be a key factor. Your lawyer may focus on highlighting the lack of credible evidence presented against you.
Gender-based violence is a broad term that refers to acts of violence committed by men against women that result in, or may result in, physical, sexual, psychological or economic harm to the victim.
This type of violence specifically targets women because of their gender and is often deeply rooted in power imbalances and discriminatory social norms.
Domestic violence, on the other hand, refers to any form of abuse that occurs within the context of a family or household relationship. This abuse may be physical, sexual, emotional, economic or psychological and can affect people of all genders, ages and social backgrounds.
Domestic violence may involve other family members, such as children, parents or siblings.
You have the right not to testify against yourself, the right to legal representation and the right to a fair and timely trial. You are also entitled to present evidence and witnesses in support of your version of events.
False domestic violence accusations are taken very seriously due to their significant impact on all parties involved. If the accusations are proven to be false, the accused may seek legal redress for damage to their reputation and for any other harm suffered.
