What does the procedure involve?

Everything begins when the victim, or someone on their behalf, files a complaint with the police, the duty court, or the Public Prosecutor’s Office.

PROTECTION ORDER

After the complaint is filed, a protection order may be requested immediately, involving urgent precautionary measures to protect the victim.

This order may include a prohibition preventing the aggressor from approaching or communicating with the victim and, in some cases, measures related to child custody or use of the family home.

INVESTIGATION

An investigation phase begins, during which all necessary evidence is gathered: witness statements, medical reports, forensic evidence, etc.

This period is crucial to determine whether the case can proceed to trial.

TRIAL

If there is sufficient evidence, the case goes to trial. During the trial, both parties, prosecution and defense, present their arguments, evidence, and witness statements before the court in an oral hearing.

JUDGMENT

After assessing the evidence and arguments, a judgment is issued, which may include criminal measures, such as prison sentences, restraining orders, communication bans, and civil measures, such as child custody, use of the family home, or child support.

APPEAL

The judgment issued by the Criminal Court may be appealed within 5 days before the Provincial Court.
