MY GENDER SELF-DETERMINATION
The first trans lawyer in Spain to officially transition gender in the Civil Registry, which has served to illustrate the simplicity of the legal process and how it affects the application of the law in specific contexts such as gender violence.
THE LACK OF ADDITIONAL REQUIREMENTS
Despite media pressure, I was able to clearly demonstrate that changing gender in the civil registry and on the DNI can be a direct and accessible process, requiring only the presentation of existing identity documentation, without the need to meet additional requirements.
LEGAL IMPLICATIONS OF TRANSITION
According to article 46 of the Trans Law, crimes committed before transitioning from male to female are judged under the previous male identity, while any crime committed post-transition is judged under the new female identity.
This has significant implications for how violence cases are handled. For example, under current law, a trans woman cannot be judged under specific gender violence laws post-transition, but instead would be judged under domestic violence laws.

What does the procedure consist of?
The Trans Law in Spain facilitates and regulates the gender change process in official records, guaranteeing the right to gender self-determination without the need for medical, psychological or hormonal intervention.
REQUIREMENTS
– No requirements from the age of 16.
– Minors between 14 and 16 must be accompanied by their parents, while if the minor does not have their consent, a judicial defender will be appointed to resolve the conflict.
– From ages 12 to 14, gender can also be changed provided the minor has judicial authorization.
– Children under 12 cannot change the registered sex marker but can change their name to align it with the gender they identify with.
TIMEFRAMES
Once the application is submitted to the Civil Registry, it must be ratified within a maximum period of three months and approximately one month later, the ruling granting or denying the gender change will be issued.
REVERSIBILITY
The law allows that after six months, a trans person may request to return to their original sex.
SANCTIONS
Acts of discrimination against LGTBIQ+ individuals will be punished with fines of up to €150,000.
APPEALS
Administrative: If your application is denied, you may appeal to the General Directorate of Registries and Notaries of the Ministry of Justice.
Judicial: Once the administrative route is exhausted, you may file a contentious-administrative appeal before the court.
